Loyalty Program and Promotions Terms

Scope
These Loyalty Program and Promotions Terms apply to the scratch card loyalty mechanic and the fries promotion communicated by Pellegrino DE UG (haftungsbeschränkt) in Germany. They apply in addition to the website Terms of Use and the platform terms of any third-party ordering channel.
Definitions
Scratch Card means a physical scratch card issued by us to eligible customers.
Eligible Spend means the total value of eligible items in an order, excluding tips and any third-party service fees unless we expressly state otherwise.
Ordering Channels means pickup ordering via our own ordering interface (including any white-label solution) and delivery ordering via third-party delivery platforms.
Eligibility
The program is open to customers in Germany. Participation is voluntary.
Employees and contractors of Pellegrino may be excluded.
Where a prize contains age-restricted items, we will only redeem it for customers who can lawfully receive that item and who can provide age verification when required.
How you earn Scratch Cards
You earn 1 Scratch Card for every EUR 20 of Eligible Spend in a single order.
The EUR 20 threshold is calculated per order and is not cumulative across multiple orders.
We may set reasonable limits per customer per day to prevent abuse.
Delivery orders
If a delivery order qualifies, the Scratch Card may be included in the delivery bag or provided via an alternative method we communicate at the time of ordering.
Prizes and odds
Each Scratch Card reveals one outcome. Outcomes may include prizes and may include a no-prize outcome.
Prizes may include, for example, free items, discounts, or upgrades. The exact list of possible outcomes is communicated by us and may vary by location and time.
Prizes are subject to availability. If a specific prize is unavailable, we may substitute an item of equal or similar value.
Redemption rules
Unless we state otherwise, Scratch Card prizes are redeemable only in Germany through eligible Ordering Channels.
A prize can be redeemed only once per Scratch Card.
A Scratch Card has no cash value and cannot be exchanged for cash.
Scratch Cards are not transferable and may not be resold.
Expiration
Scratch Cards expire after [INSERT NUMBER] days from the order date unless a different expiry is printed on the card. Expired Scratch Cards are void.
Combining prizes with other promotions
Unless we expressly allow it, Scratch Card prizes cannot be combined with other discounts, vouchers, or promotions in the same order.
We may allow combinations in specific cases and will communicate that at the time of redemption.
Free fries promotion for pickup orders
If communicated as active, free fries are included for pickup orders above EUR 15 of Eligible Spend, provided the customer is not using other promotions or discounts in the same pickup order.
This benefit may be limited to one portion per order and subject to availability.
We may pause, modify, or discontinue this benefit at any time.
Exclusions
We may exclude certain products or categories from Eligible Spend or from redemption, including where legally required or where operationally necessary.
If we exclude a category, we will communicate it in the relevant channel or at checkout where possible.
Third-party platform fees and tips are always excluded from Eligible Spend unless we explicitly state otherwise.
Fraud, misuse, and errors
We may refuse to issue or redeem Scratch Cards, or void outcomes, in cases of suspected fraud, abuse, manipulation, duplication, or violation of these terms.
If a Scratch Card is damaged or unreadable, we may refuse redemption unless we can reasonably verify its validity.
Obvious printing or technical errors do not create an entitlement to a specific prize.
Taxes
Any taxes related to prizes, if applicable, are the responsibility of the customer unless mandatory law provides otherwise.
Changes and termination
We may change, suspend, or end the loyalty program and any promotion at any time.
Changes apply from the time they are published or communicated.
If we end the program, we may set a reasonable grace period for redeeming valid Scratch Cards.
Liability
Nothing in these terms limits liability where such limitation is not permitted by law. Liability for intent and for injury to life, body, or health is not excluded.
Governing law and jurisdiction
Business customers (B2B)
If you are acting as a business, these terms and disputes arising out of them are governed by Italian law, and the courts of Milan have jurisdiction, unless mandatory law provides otherwise.
Consumers (B2C)
If you are a consumer, mandatory consumer protection rules and consumer jurisdiction rules applicable to you cannot be waived by contract. To the extent permitted, German law applies for the operator established in Germany.
